Mesothelioma
is a form of cancer that is almost always caused by previous exposure to asbestos. In this disease, malignant cells develop in the mesothelium, a protective lining that covers most of the body's internal organs. Its most common site is the pleura (outer lining of the lungs and chest cavity), but it may also occur in the peritoneum (the lining of the abdominal cavity) or the pericardium (a sac that surrounds the heart).
Most people who develop mesothelioma have worked on jobs where they inhaled asbestos particles, or they have been exposed to asbestos dust and fibre in other ways, such as by washing the clothes of a family member who worked with asbestos. Unlike lung cancer, there is no association between mesothelioma and smoking. Compensation via asbestos funds or lawsuits is an important issue in mesothelioma (see asbestos and the law).
The symptoms of mesothelioma include shortness of breath due to pleural effusion (fluid between the lung and the chest wall) or chest wall pain, and general symptoms such as weight loss. The diagnosis can be made with chest X-rays and a CT scan, and confirmed with a biopsy (tissue sample) and microscopic examination. A thoracoscopy (inserting a tube with a camera into the chest) can be used to take biopsies. It allows the introduction of substances such as talc to obliterate the pleural space (called pleurodesis), which prevents more fluid from accumulating and pressing on the lung. Despite treatment with chemotherapy, radiation therapy or sometimes surgery, the disease carries a poor prognosis. Research about screening tests for the early detection of mesothelioma is ongoing.

"The primary risk factor for developing mesothelioma is asbestos exposure. I believe I saw a statistic, and you know what they say about statistics, that said 80% of mesothelioma diagnoses are related to asbestos exposure. This does sound about right. Certain exposures to radiation also are known to develop mesothelioma. You have probably seen ads on TV that certain law groups want you to call them. I often wonder if the attorneys benefit from these class action lawsuits more than the victim. Less of a percentage if it settles before trial, more if he has to go to court.It is all negotiable between the client and the lawyer, but he will not take only 10%. Why not charge less? Would you go to your boss and volunteer to take less to do your job? Everyone that works is trying to earn as much money as they can.If the lawyer did not care about injured persons, he could become a tax lawyer instead. "Why doesn't he charge less? Because lawyers charge a lot of money, and taking on class action and malpractice suits are risky - so you want a big chunk of the pie. Lawyers start charging at $200 an hour - and those are green associates and family lawyers, not the guys raking in the big bucks. My boyfriend's boss, who's a junior partner at a small firm in Toronto, charges $450 per billable hour, plus costs. My friend's father, who's a senior partner at one of the biggest firms in the country makes somewhere around 1.3 million dollars a year. Running a law firm isn't cheap, either. Searches through Westlaw and such cost money; the facilities you rent cost money; court filing fees cost money; so does that suit your lawyer wears, their desk, the paralegals and secretaries, etcetera, etcetera. And yes, lawyers care if you receive damages. Why? They want a reputation for being a good lawyer, and they don't want to get disbarred or sued for doing a crappy job. Strangely enough, we get fairly attached to our clients, too, especially the ones that were treated unfairly."
